These 使用条款 (“Terms”) constitute a legally binding agreement between PayForSay s.r.o., a limited liability company incorporated under the laws of the Slovak Republic, with its registered office at Doležalova 3424/15C, Bratislava – Ružinov, 821 04, Slovakia, 业务 ID (IČO): 54455073, Tax ID (DIČ): 2121683322, VAT ID: SK2121683322 (“Company,” “7Stamp,” “we,” “us,” or “our”), and you (“User,” “Merchant,” or “you”) governing your access to and use of the website 7stamp.com , the 7Stamp mobile application, the 7Stamp 员工 扫描ner application, and 相关 services, including 数字 忠诚度 passes (collectively, the “Service”).

By creating an account, installing a 数字 忠诚度 卡 (“钱包 Pass”), or using the Service, you acknowledge that you have 阅读, understood, and agree to be bound by these Terms and our 隐私政策 Policy.

• Merchant: A 业务 entity using the Service to 管理 忠诚度 活动 and issue 数字 印章.
• End User: An individual who collects 印章 and 奖励 using 数字 卡片 in Apple Wallet or Google Wallet.
• 员工 扫描ner App: The “7Stamp 员工 扫描ner” application used by Merchant’s employees to validate 印章.
• Transactional Communications: Essential messages necessary for the operation of the 忠诚度 program (e.g., 印章 updates, security alerts).
• Marketing Communications: Optional messages intended to promote products, including geo-fenced alerts and birthday 奖励.
• ADMT: Automated Decision-Making Technology used for 忠诚度 progression and birthday 奖励.

3.1. Age Requirement: You must be at least 16 years old to use the Service.

3.2. Registration: You agree to provide accurate information via Apple, Google, or other supported authentication methods. You are responsible for the security of your account credentials.

3.3. Merchant Responsibility: Merchants are solely responsible for all activities under their account, including actions by employees using the 员工 扫描ner App.

4.1. Dual-Consent Interface: Upon 卡 installation, the Service requires (i) mandatory acceptance of these Terms and 隐私政策 Policy, and (ii) optional, explicit opt-in for Marketing Communications.

4.2. Marketing Opt-In: Marketing communications (Push, Email, Geolocation alerts, and 生日奖励) are only sent if the User provides explicit consent.

4.3. Withdrawal: Users may unsubscribe via the “Unsubscribe” link in emails or the Preference Center. Push notifications are managed via device-level 钱包 settings.

5.1. License: We grant you a limited, non-exclusive, revocable license to use the Service for personal or internal 业务 use.

5.2. Ownership: All rights, title, and interest in the Service belong exclusively to PayForSay s.r.o..

5.3. Merchant Content: Merchant grants us a worldwide, royalty-free license to use its logos and trademarks solely for providing the Service.

6.1. Merchant of Record: All orders are processed by Paddle.com, our Merchant of Record. Payments are subject to Paddle’s Terms and Conditions.

You agree NOT to:

• Use the Service for illegal purposes or to promote restricted goods (tobacco, weapons, adult content).
• Violate Apple Wallet or Google Wallet developer policies.
• Reverse engineer or attempt to extract the source code of the Service.

The Service is designed to comply with the European Accessibility Act (EAA). We aim for WCAG 2.1 Level AA conformance for 数字 passes and the 员工 扫描ner App.

To the maximum extent permitted by Slovak law (Commercial Code § 373 et seq.), our total liability is limited to the amount paid by you in the 12 months preceding the claim. For free users, liability is limited to €50.

10.1. Governing Law: These Terms are governed by the laws of the Slovak Republic.

10.2. Jurisdiction:

• EU Consumers/B2B: Courts of Bratislava, Slovakia.
• US Users: Binding arbitration administered by the American Arbitration Association (AAA).
