Lietošanas noteikumi

These Lietošanas noteikumi (“Noteikumi”) constitute legally binding agreement between PayForSay s.r.o., limited liability company incorporated under laws of Slovak Republic, with its registered office at Doležalova 3424/15C, Bratislava – Ružinov, 821 04, Slovakia, Business ID (IČO): 54455073, Tax ID (DIČ): 2121683322, VAT ID: SK2121683322 (“Company,” “7Stamp,” “we,” “us,” or “our”), and you (“User,” “Merchant,” or “you”) governing your access to and use of website 7stamp.com , 7Stamp mobile application, 7Stamp Scanner application, and related services, including digitālā lojalitāte passes (collectively, “Service”).

By creating account, installing digital lojalitātes karte (“Wallet Pass”), or using Service, you acknowledge that you have lasīt, understood, and agree to be bound by these Noteikumi and our Privātuma politika.

• Merchant: A business entity using Service to pārvaldīt loyalty kampaņas and issue digitālie zīmogi.
• End User: An individual who collects zīmogi and atlīdzības using digital kartes in Apple Wallet vai Google Wallet.
• Scanner App: The “7Stamp Scanner” application used by Merchant’s employees to validēt zīmogi.
• Transactional Communications: Essential messages necessary for operācija of lojalitātes programma (e.g., zīmogs updates, security alerts).
• Marketing Communications: Optional messages intended to promote products, including geo-fenced alerts and birthday atlīdzības.
• ADMT: Automated Decision-Making Technology used for loyalty progression and birthday atlīdzības.

3.1. Age Requirement: You must be at least 16 years old to use Service.

3.2. Registration: You agree to provide accurate information via Apple, Google, or other supported authentication methods. You are responsible for security of your account credentials.

3.3. Merchant Responsibility: Merchants are solely responsible for all activities under their account, including actions by employees using Scanner App.

4.1. Dual-Consent Interface: Upon karte installation, Service requires (i) mandatory acceptance of these Noteikumi and Privātuma politika, and (ii) optional, explicit opt-in for Marketing Communications.

4.2. Marketing Opt-In: Marketing communications (Push, Email, Geolocation alerts, and Birthday atlīdzības) are only sent if User provides explicit consent.

4.3. Withdrawal: Users may unsubscribe via “Unsubscribe” saite in emails or Preference Center. Push notifications are managed via device-level Wallet settings.

5.1. License: We grant you limited, non-exclusive, revocable license to use Service for personal or internal business use.

5.2. Ownership: All rights, title, and interest in Service belong exclusively to PayForSay s.r.o..

5.3. Merchant Content: Merchant grants us worldwide, royalty-free license to use its logos and trademarks solely for providing Service.

6.1. Merchant of Record: All orders are processed by Paddle.com, our Merchant of Record. Maksājumi are subject to Paddle’s Noteikumi and Conditions.

6.2. Atmaksas politika: Our atmaksa and cancellation rules are governed by our Atmaksas politika, incorporated here by reference: /lv/refund

You agree NOT to:

• Use Service for illegal purposes or to promote restricted goods (tobacco, weapons, adult content).
• Violate Apple Wallet vai Google Wallet developer policies.
• Reverse engineer or attempt to extract source code of Service.

The Service is designed to comply with European Accessibility Act (EAA). We aim for WCAG 2.1 Level AA conformance for digital passes and Scanner App.

To maximum extent permitted by Slovak law (Commercial Code § 373 et seq.), our total liability is limited to amount paid by you in 12 months preceding claim. For free users, liability is limited to €50.

10.1. Governing Law: These Noteikumi are governed by laws of Slovak Republic.

10.2. Jurisdiction:

• EU Consumers/B2B: Courts of Bratislava, Slovakia.
• US Users: Binding arbitration administered by American Arbitration Association (AAA).
