These उपयोग की शर्तें (“Terms”) constitute a legally binding agreement between PayForSay s.r.o., a limited liability company incorporated under the laws of the Slovak Republic, with its registered office at Doležalova 3424/15C, Bratislava – Ružinov, 821 04, Slovakia, व्यवसाय ID (IČO): 54455073, Tax ID (DIČ): 2121683322, VAT ID: SK2121683322 (“Company,” “7Stamp,” “we,” “us,” or “our”), and you (“User,” “Merchant,” or “you”) governing your access to and use of the website 7stamp.com , the 7Stamp mobile application, the 7Stamp स्कैनर application, and संबंधित services, including डिजिटल लॉयल्टी passes (collectively, the “Service”).

By creating an account, installing a डिजिटल लॉयल्टी कार्ड (“वॉलेट Pass”), or using the Service, you acknowledge that you have पढ़ें, understood, and agree to be bound by these Terms and our प्राइवेसी Policy.

• Merchant: A व्यवसाय entity using the Service to प्रबंधित करें लॉयल्टी अभियान and issue डिजिटल स्टैम्प्स.
• End User: An individual who collects स्टैम्प्स and रिवॉर्ड्स using डिजिटल कार्ड्स in Apple Wallet or Google Wallet.
• स्कैनर ऐप: The “7Stamp स्कैनर” application used by Merchant’s employees to validate स्टैम्प्स.
• Transactional Communications: Essential messages necessary for the operation of the लॉयल्टी program (e.g., स्टैम्प updates, security alerts).
• Marketing Communications: Optional messages intended to promote products, including geo-fenced alerts and birthday रिवॉर्ड्स.
• ADMT: Automated Decision-Making Technology used for लॉयल्टी progression and birthday रिवॉर्ड्स.

3.1. Age Requirement: You must be at least 16 years old to use the Service.

3.2. Registration: You agree to provide accurate information via Apple, Google, or other supported authentication methods. You are responsible for the security of your account credentials.

3.3. Merchant Responsibility: Merchants are solely responsible for all activities under their account, including actions by employees using the स्कैनर ऐप.

4.1. Dual-Consent Interface: Upon कार्ड installation, the Service requires (i) mandatory acceptance of these Terms and प्राइवेसी Policy, and (ii) optional, explicit opt-in for Marketing Communications.

4.2. Marketing Opt-In: Marketing communications (Push, Email, Geolocation alerts, and Birthday रिवॉर्ड्स) are only sent if the User provides explicit consent.

4.3. Withdrawal: Users may unsubscribe via the “Unsubscribe” link in emails or the Preference Center. Push notifications are managed via device-level वॉलेट settings.

5.1. License: We grant you a limited, non-exclusive, revocable license to use the Service for personal or internal व्यवसाय use.

5.2. Ownership: All rights, title, and interest in the Service belong exclusively to PayForSay s.r.o..

5.3. Merchant Content: Merchant grants us a worldwide, royalty-free license to use its logos and trademarks solely for providing the Service.

6.1. Merchant of Record: All orders are processed by Paddle.com, our Merchant of Record. Payments are subject to Paddle’s Terms and Conditions.

You agree NOT to:

• Use the Service for illegal purposes or to promote restricted goods (tobacco, weapons, adult content).
• Violate Apple Wallet or Google Wallet developer policies.
• Reverse engineer or attempt to extract the source code of the Service.

The Service is designed to comply with the European Accessibility Act (EAA). We aim for WCAG 2.1 Level AA conformance for डिजिटल passes and the स्कैनर ऐप.

To the maximum extent permitted by Slovak law (Commercial Code § 373 et seq.), our total liability is limited to the amount paid by you in the 12 months preceding the claim. For free users, liability is limited to €50.

10.1. Governing Law: These Terms are governed by the laws of the Slovak Republic.

10.2. Jurisdiction:

• EU Consumers/B2B: Courts of Bratislava, Slovakia.
• US Users: Binding arbitration administered by the American Arbitration Association (AAA).
