These شرایط استفاده (“شرایط”) constitute a legally binding agreement between PayForSay s.r.o., a limited liability company incorporated under the laws of the Slovak Republic, with its registered office at Doležalova 3424/15C, Bratislava – Ružinov, 821 04, Slovakia, کسب‌وکار ID (IČO): 54455073, Tax ID (DIČ): 2121683322, VAT ID: SK2121683322 (“Company,” “7Stamp,” “we,” “us,” or “our”), and you (“User,” “Merchant,” or “you”) governing your access to and use of the وب‌سایت 7stamp.com , the 7Stamp mobile application, the 7Stamp Scanner application, and related سرویس‌ها, including وفاداری دیجیتال passes (collectively, the “سرویس”).

By creating an account, installing a digital کارت وفاداری (“Wallet Pass”), or using the سرویس, you acknowledge that you have مطالعه, understood, and agree to be bound by these شرایط and our سیاست حریم خصوصی.

• Merchant: A کسب‌وکار entity using the سرویس to مدیریت وفاداری کمپین‌ها and صدور digital stamps.
• End User: An individual who collects stamps and پاداش‌ها using digital کارت‌ها in Apple Wallet یا Google Wallet.
• Scanner App: The “7Stamp Scanner” application used by Merchant’s employees to اعتبارسنجی stamps.
• Transactional Communications: Essential پیام‌ها necessary for the عملیات of the برنامه وفاداری (e.g., stamp updates, security alerts).
• Marketing Communications: Optional پیام‌ها intended to معرفی products, including geo-fenced alerts and birthday پاداش‌ها.
• ADMT: Automated تصمیم-Making Technology used for وفاداری progression and birthday پاداش‌ها.

3.1. Age Requirement: You must be at least 16 سال old to use the سرویس.

3.2. ثبت‌نام: You agree to provide accurate information via Apple, Google, or other supported authentication methods. You are responsible for the security of your account credentials.

3.3. Merchant Responsibility: Merchants are solely responsible for all activities under their account, including اقدام‌ها by employees using the Scanner App.

4.1. Dual-Consent رابط: Upon کارت installation, the سرویس requires (i) mandatory acceptance of these شرایط and سیاست حریم خصوصی, and (ii) optional, explicit opt-in for Marketing Communications.

4.2. Marketing Opt-In: Marketing communications (Push, Email, Geolocation alerts, and Birthday پاداش‌ها) are only sent if the User provides explicit consent.

4.3. Withdrawal: Users may unsubscribe via the “Unsubscribe” لینک in emails or the Preference Center. Push notifications are managed via device-level Wallet settings.

5.1. License: We grant you a limited, non-exclusive, revocable license to use the سرویس for personal or internal کسب‌وکار use.

5.2. Ownership: All rights, title, and interest in the سرویس belong exclusively to PayForSay s.r.o..

5.3. Merchant Content: Merchant grants us a worldwide, royalty-رایگان license to use its logos and trademarks solely for providing the سرویس.

6.1. Merchant of Record: All orders are processed by Paddle.com, our Merchant of Record. پرداخت‌ها are subject to Paddle’s شرایط and Conditions.

You agree NOT to:

• Use the سرویس for illegal purposes or to معرفی restricted goods (tobacco, weapons, adult content).
• Violate Apple Wallet یا Google Wallet developer policies.
• Reverse engineer or attempt to extract the source code of the سرویس.

The سرویس is designed to comply with the European Accessibility Act (EAA). We aim for WCAG 2.1 Level AA conformance for digital passes and the Scanner App.

To the maximum extent permitted by Slovak law (Commercial Code § 373 et seq.), our total liability is limited to the amount paid by you in the 12 ماه preceding the claim. For رایگان users, liability is limited to €50.

10.1. Governing Law: These شرایط are governed by the laws of the Slovak Republic.

10.2. Jurisdiction:

• EU Consumers/B2B: Courts of Bratislava, Slovakia.
• US Users: Binding arbitration administered by the American Arbitration Association (AAA).
