Terms of Use

Effective Date: May 26, 2026

1. INTRODUCTION AND SCOPE

These Terms of Use (“Terms”) constitute a legally binding agreement between PayForSay s.r.o., a limited liability company incorporated under the laws of the Slovak Republic, with its registered office at Doležalova 3424/15C, Bratislava – Ružinov, 821 04, Slovakia, Business ID (IČO): 54455073, Tax ID (DIČ): 2121683322, VAT ID: SK2121683322 (“Company,” “7Stamp,” “we,” “us,” or “our”), and you (“User,” “Merchant,” or “you”) governing your access to and use of the website https://7stamp.com, the 7Stamp mobile application, the 7Stamp Scanner application, and related services, including digital loyalty passes (collectively, the “Service”).

By creating an account, installing a digital loyalty card (“Wallet Pass”), or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. DEFINITIONS

  • Merchant: A business entity using the Service to manage loyalty campaigns and issue digital stamps.
  • End User: An individual who collects stamps and rewards using digital cards in Apple Wallet or Google Wallet.
  • Scanner App: The “7Stamp Scanner” application used by Merchant’s employees to validate stamps.
  • Transactional Communications: Essential messages necessary for the operation of the loyalty program (e.g., stamp updates, security alerts).
  • Marketing Communications: Optional messages intended to promote products, including geo-fenced alerts and birthday rewards.
  • ADMT: Automated Decision-Making Technology used for loyalty progression and birthday rewards.

3. ELIGIBILITY AND ACCOUNTS

3.1. Age Requirement: You must be at least 16 years old to use the Service. 

3.2. Registration: You agree to provide accurate information via Apple, Google, or other supported authentication methods. You are responsible for the security of your account credentials.

 3.3. Merchant Responsibility: Merchants are solely responsible for all activities under their account, including actions by employees using the Scanner App.

4. CONSENT AND COMMUNICATION PREFERENCES

4.1. Dual-Consent Interface: Upon card installation, the Service requires (i) mandatory acceptance of these Terms and Privacy Policy, and (ii) optional, explicit opt-in for Marketing Communications.

4.2. Marketing Opt-In: Marketing communications (Push, Email, Geolocation alerts, and Birthday rewards) are only sent if the User provides explicit consent.

 4.3. Withdrawal: Users may unsubscribe via the “Unsubscribe” link in emails or the Preference Center. Push notifications are managed via device-level Wallet settings.

5. SAAS LICENSE AND INTELLECTUAL PROPERTY

5.1. License: We grant you a limited, non-exclusive, revocable license to use the Service for personal or internal business use.

5.2. Ownership: All rights, title, and interest in the Service belong exclusively to PayForSay s.r.o..

5.3. Merchant Content: Merchant grants us a worldwide, royalty-free license to use its logos and trademarks solely for providing the Service.

6. FEES AND PAYMENTS (FOR MERCHANTS)

6.1. Merchant of Record: All orders are processed by Paddle.com, our Merchant of Record. Payments are subject to Paddle’s Terms and Conditions.

6.2. Refund Policy: Our refund and cancellation rules are governed by our Refund Policy, incorporated here by reference: https://7stamp.com/en/refund-policy/.

7. ACCEPTABLE USE POLICY (AUP)

You agree NOT to:

  • Use the Service for illegal purposes or to promote restricted goods (tobacco, weapons, adult content).
  • Violate Apple Wallet or Google Wallet developer policies.
  • Reverse engineer or attempt to extract the source code of the Service.

8. DIGITAL ACCESSIBILITY (EAA)

The Service is designed to comply with the European Accessibility Act (EAA). We aim for WCAG 2.1 Level AA conformance for digital passes and the Scanner App.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by Slovak law (Commercial Code § 373 et seq.), our total liability is limited to the amount paid by you in the 12 months preceding the claim. For free users, liability is limited to €50.

10. GOVERNING LAW AND JURISDICTION

10.1. Governing Law: These Terms are governed by the laws of the Slovak Republic.

10.2. Jurisdiction:

  • EU Consumers/B2B: Courts of Bratislava, Slovakia.

US Users: Binding arbitration administered by the American Arbitration Association (AAA).
